ENERGYQUEST Terms of Service

We're EnergyQuest. We provide a real-world, location-based, community-driven game. Our mission is to create an engaging and immersive experience that encourages players to discover new places, connect with others, and enjoy the thrill of competition in a safe and respectful environment.

1. Acceptance of Terms

By accessing or using the EnergyQuest mobile game ("Service"), you affirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. EnergyQuest reserves the right to modify these Terms at any time without prior notice.

2. Account Information

You must create an account to use the Service, which requires a supported mobile phone and internet access. You are responsible for maintaining the security of your account and for all activities that occur under the account. Sharing, selling, or otherwise transferring your account is prohibited.
You must be 13 years of age or older to create an EnergyQuest account. By creating an account, you represent and warrant that you are at least 13 years old. This requirement is in place to ensure the safety and compliance of our users with relevant laws and regulations.

3. User Conduct

You are expected to behave in a respectful and lawful manner at all times when using the Service. Harassment, cheating, exploiting bugs, or engaging in any activity that gives an unfair advantage is strictly prohibited.
In addition to online conduct, we expect all users to maintain proper and respectful behavior during offline gameplay. This includes, but is not limited to:

Adhering to Local Laws and Regulations: Always respect local laws and regulations while playing. This includes observing traffic rules and other public safety ordinances to ensure not only your safety but also the safety of others around you.
Respecting Private Property: Do not trespass on private property or restricted areas while engaging in gameplay. Always seek permission if your gameplay leads you to private premises.
Consideration for Public Spaces: Be mindful of your surroundings and the people within them. Avoid disruptive behavior in public spaces and maintain a courteous demeanor to fellow citizens and players.

Your actions in the physical world while playing EnergyQuest should align with the spirit of the game, promoting a safe, enjoyable, and respectful environment for all.

4. Intellectual Property

All rights, title, and interest in and to the Service, including all associated intellectual property rights, are owned by EnergyQuest. You may not use any content from the Service without our express permission, except as permitted by law.

5. Virtual Goods and Currency

The Service may include virtual goods and currencies that have no real-world monetary value and cannot be exchanged for real money or monetary value. All purchases of virtual goods and currencies are final and non-refundable.

6. Updates and Downtime

EnergyQuest may update the Service at any time. These updates may require you to accept additional terms or update your app. Scheduled and unscheduled interruptions may occur, and EnergyQuest will not be liable for any downtime.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties, express or implied, including the implied warranties of merchantability or fitness for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by applicable law, EnergyQuest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injuries, property damage, lost profits, data, or use of the Service, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.
You specifically acknowledge that EnergyQuest is not liable for any injuries or accidents that may occur as a result of your use of the Service in real-world environments. You agree to maintain awareness of your surroundings at all times and play safely. Your use of the Service is at your sole risk.

9. Termination

EnergyQuest reserves the right to terminate or suspend your account if you violate these Terms or engage in any illegal or harmful conduct.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Estonia, without regard to its conflict of law provision.
Any disputes or claims arising out of or in connection with these Terms that cannot be resolved informally or in small claims court shall be resolved exclusively by the courts located in Tartu, Estonia. You agree to the personal jurisdiction by and venue in the courts in Tartu, Estonia, and waive any objection to such jurisdiction or venue.

12. Changes to Terms

EnergyQuest may modify these Terms at any time. We will notify users of any changes by posting the new Terms on our website or within the Service. Your continued use of the Service after any changes come into effect constitutes your agreement to the new Terms.
